PANAJI: The High Court of Bombay at Goa disposed of the Suo Motu Writ Petition of 2007 regarding garbage management facilities in all 191 panchayats of Goa taking cognizance of the fact that almost every panchayat has established a Material Recovery Facility (MRF).
Advocate General Devidas Pangam said that the petition has been disposed of with cost to be paid to the amicus curie by the defaulting Panchayats.
Bhati Panchayat which has still not set up the facility has been given 6 months to do so.
Hearing in the Aldona Panchayat whose MRF is set up has been scheduled for tomorrow in a matter related to a local level problem.
The Court has also directed the Goa State Pollution Control Board to monitor the MRF facilities and ensure that Panchayats continue to operate them.
The HC stated, “It is possible that the administrator was unaware of the various orders made by this court and the fact that this court was monitoring the progress of setting up of MRFs.
Now that the Aldona panchayat has started the work, the Administrator has, prima facie, without taking cognizance of the community resolution, proceeded to stop this work.”
The HC had ruled that the administrator needed to be informed of all such orders and ongoing legal actions.
