In a decision that underscores the challenges of balancing infrastructure development with environmental preservation, the High Court of Bombay at Goa has given the green light for the translocation of a centuries-old banyan tree to facilitate the construction of a six-lane elevated corridor on National Highway 66. This ruling, made on a recent Tuesday, comes as a significant development in the ongoing debate over the project’s environmental impact. The court’s decision sets a tight timeline for the tree’s relocation, mandating that it be moved between March 5 and 10, with strict adherence to expert guidelines.
The High Court’s order resolves a miscellaneous civil application, paving the way for the project’s progress while addressing concerns about the tree’s survival. Environmentalists have expressed apprehension, citing past unsuccessful tree translocations in the region. For instance, five trees transplanted in Socorro are reportedly struggling to survive, raising doubts about the success of this endeavor. Environmentalist Avertino Miranda voiced these concerns, highlighting the potential risks and the lengthy regrowth period anticipated by expert reports.
Advocate General Devidas Pangam confirmed that the court accepted the government’s detailed plan for the translocation, which includes supervision by the Forest Department to ensure all precautions are taken. Landscape designer Daniel D’Souza suggested a cautious approach, emphasizing the need for scientific methods to ensure the tree’s survival, especially during the upcoming summer. He proposed cutting the tree into parts to facilitate easier translocation and maintaining an adequate canopy.
Parag Mody’s expert report emphasized the importance of involving qualified professionals in future tree translocations and recommended gradual pruning to reduce stress on the tree. Despite these measures, environmentalists are considering further legal action, including a review petition or an appeal to the Supreme Court.
