PANAJI: In accordance with Articles 12 and 16 of the Constitution, as well as the provisions of the Goa School Education Act, 1984 and Rules, 1986, as applicable, Chairperson of the Goa Commission for Scheduled Castes and Scheduled Tribes Deepak Karmalkar passed an order on Thursday recommending that the Directorate of Education (DoE) make sure that all aided schools, including minority institutions in Goa, strictly adhere to the reservation policy of the Goa government for the recruitment and promotion of all teaching and non-teaching employees falling under the Scheduled Caste and Scheduled Tribe category. In its ruling in the case brought by the state’s All India Adivasi Workers Federation against the Goa government’s secretary of education and the director of education, the commission ordered the department to produce a compliance report.
Adv. Upasso Gaunkar, the president of the All India Adivasi Employees Federation (Goa), had petitioned the commission, pleading with the director of education to promptly instruct all state-aided schools to adhere to the reservation policy, maintain the post-based roster system appropriately, fill any backlog of reserved positions as soon as possible, and relinquish any posts reserved for SCs and STs that are currently occupied by individuals from unreserved and other categories.
The panel noted that before authorising the hiring of new employees or the appointment of existing personnel in the aided schools, the Directorate of Education failed to take appropriate action regarding the reservation and upkeep of the post-based roster system. Additionally, it was noted that the Directorate of Education had neglected to apply the authority bestowed upon it by the Goa School Education Act to those establishments that were deviating from its own directives regarding adherence to the reservation policy and provision of employment in accordance with roster maintenance.Before giving any approval or NOC to fill the positions in any of the aided schools within the Directorate of Education’s jurisdiction, the department is required to confirm the post-based roster’s status.
