PANAJI: The petition filed seeking disqualification of ten former Congress MLAs will be heard next week by the special divison bench of Bombay High Court at Goa, after justice Mahesh Sonal recused himself from hearing the plea.
Congress president Girish Chodankar had moved High Court challenging the disqualification order passed by the Speaker of Goa Legislative Assembly, in April.
Speaker had dismissed the disqualification plea.
When the matter came up for hearing today morning, senior counsel Advocate Kapil Sibbal, appearing for the petitioner, pleaded for urgent hearing in the matter considering that the term of the current State Assembly is expiring in March 2022.
However, Justice Sonak recused himself from hearing the plea stating that he had appeared for some of the respondents in other matters earlier.
High Court said that due to unavailability of judges, the matter can’t be heard this week and hence it will be heard by Special Division Bench next week.
The petitioners had claimed that all 10 respondents have incurred disqualification under Article 191(2) of the Constitution read with para 2 of the Tenth Schedule and are liable to be disqualified as Member of the Legislative Assembly.
