PANAJI: On the grounds that Madhav Sahakari was disqualified by the Registrar of Co-operative Societies (RCS) from serving on the board of directors of the Goa State Co-operative Milk Producers Union Ltd (Goa Dairy), the High Court of Bombay, Goa, on Thursday overturned the order disqualifying him as a director of the Kapila Sahakari Dudh Utpadak Vyavasayik Saunstha Maryadit, Curti-Ponda.
On the grounds that the RCS had disqualified him from serving as a director of the Goa Dairy, Sahakari had filed a writ petition contesting the order dated January 28, 2025, issued by the Assistant RCS, ordering the Kapila Sahakari Dudh Utpadak Vyavasayik Saunstha Maryadit to remove the petitioner from his directorship.
Senior advocate A F Diniz argued on behalf of the petitioner, stating that Sahakari had resigned from the Goa Dairy board of directors on February 23, 2023, and that the RCS had disqualified the petitioner and ten other Goa Dairy board members from remaining directors in an order dated April 21, 2023.
They were disqualified for acting against the interests of the Goa Dairy and for adopting resolutions in 2017. Adv. Diniz argued that the petitioner’s disqualification as a director of the Kapila Sahakari Dudh Utpadak Vyavasayik Saunstha Maryadit could not be justified by Sahakari’s disqualification from the Goa Dairy board of directors.
Sahakari’s disqualification from the Goa Dairy board of directors, according to Adv. Diniz, had no influence on his directorship at the Kapila Sahakari Dudh Utpadak Vyavasayik Saunstha Maryadit.
Additionally, the Act makes no mention of such automatic disqualification just because the petitioner is ineligible to serve on the Goa Dairy board of directors. He said that the Assistant RCS issued the order entirely on the incorrect pretext.
