Panaji: The Goa Coastal Zone Management Authority (GCZMA) has ordered the demolition of an unauthorized building in Siolim, after finding that the occupants had misused the Mundkar Act to assert ownership over multiple government properties.
The structure, reportedly built around 2011 without the necessary permissions, was defended by Nifty Fernandes, Joe Fernandes, and Severina Fernandes, who presented a 2000 Mundkar order from the Joint Mamlatdar of Bardez claiming they had occupied the property since before 1991.
The GCZMA, however, noted discrepancies in their claims, pointing out that the same person had been recognized as a mundkar for two separate survey numbers, which are geographically distinct and do not adjoin. This, the authority said, violates the legal definition of a mundkar, which applies to a single dwelling.
Further investigations revealed that the original structures had been demolished and rebuilt with significant horizontal and vertical extensions, exceeding the original dimensions and diverging from the approved survey plans.
Following a site inspection, the GCZMA instructed the Deputy Collector to identify the original plinths and remove all unauthorized additions.
The demolition is to be supervised by the Deputy Collector, who had conducted the field inquiry into the matter.
