PANAJI: The FIR against Shrimat Shivananda Saraswati Swami of Kavale Math in a case involving the purported fraudulent sale of property in Kavale-Ponda has been canceled by the High Court of Bombay in Goa, which is a major blow to the Goa police.
Surgeon Dr. P S Ramani and another individual filed the complaint, alleging that Shrimat Swami had produced fraudulent paperwork about the Math family’s property rights. Manohar Adpaikar, Avadhut Shivram Kakodkar, and Shrimat Swami were accused of fraud, forgery, and impersonation in the real estate transaction.
The Ponda police argued throughout the court against the FIR being canceled, claiming that Shrimat Swami and his associates were not assisting with the inquiry, particularly when it came to presenting the Power of Attorney for the sale.
The selling deed, dated April 13, 2018, appeared to have been executed without the necessary two-thirds majority resolution by the Math’s Board of Trustees, according to the police.
The police claim that on March 15, 2007, the High Court authorized a consent agreement between Shree Gurudatt Sansthan and the Kavale Math Board of Trustees.
Adbhay Khandeparkar, the petitioner’s attorney, refuted the accusations, claiming that no crime had been committed. When the error was discovered, the sale deed, which had been executed in 2018 with legal counsel, was subsequently canceled.
The deal was reversed when a lawsuit was filed to revoke the sale deed. A consent decree to rescind the sale resulted from the buyer’s recognition of the error. The parties involved received their money back,” he stated.
We contend that since there was no intent, no crime was committed. Additionally, Khandeparkar noted that the charges were brought under the Indian Penal Code, which has since been repealed.
The High Court dismissed the FIR against Shrimat Swami and granted the plea after hearing the arguments.
