PORVORIM: The Goa Bench of the Bombay High Court has issued notice to Velim MLA Cruz Silva in connection with a criminal writ petition filed by social activist Subhash Bhasker Velingkar, challenging proceedings arising out of an FIR registered at the Bicholim police station.
The petition, filed under Articles 226 and 227 of the Constitution of India, pertains to FIR No. 100/2024 dated October 4, 2024, registered under Section 299 of the Bharatiya Nyaya Sanhita, 2023. The proceedings also invoke Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
The matter came up for hearing on January 9, 2026, before Justice Ashish S. Chavan. Advocates Rohan Desai and Aashay Priolkar appeared on behalf of the petitioner, while Public Prosecutor S. G. Bhobe represented the State of Goa.
The High Court issued notice to respondent numbers one and two, with the public prosecutor waiving service on their behalf. The registry was directed to issue notice to respondent number three, Cruz Silva, MLA of the Velim constituency, upon payment of the usual process fees.
The court granted liberty to the petitioner to serve respondent number three through all permissible modes and directed that an affidavit of service be filed on or before February 3, 2026.
The petition has been listed for admission on February 5, 2026, at 10.30 am. The court further directed Cruz Silva to appear either in person or through an advocate and show cause as to why the relief sought by the petitioner should not be granted, warning that failure to appear could result in orders being passed in favour of the petitioner or such other orders as deemed fit by the court.
