MARGAO: On the request made by Revenue Minister Atanasio Monserrate to the Central Bureau of Investigations (CBI) for instructions to deliver the investigation’s closure report on his counter complaint in the Panaji police station attack case, the South Goa Sessions Court has deferred making any decisions.
May 3 is when Sessions Judge Irshad Agha, the Special Judge designated by the High Court to hear criminal charges involving MPs and MLAs, is expected to make his decision.
Adv A D’Sa, Monserrate’s attorney, argued during the arguments that the CBI had not looked into his client’s countercomplaint or filed a FIR as required by the High Court.
“The CBI responded to Atanasio Monserrate’s counter complaint by filing a closure report with the Judicial Magistrate First Class.
“Since we wish to address the police officers and their involvement in the case, the investigation into the counter complaint has an impact on the current Sessions Court trial, according to Adv. D’Sa.
During the arguments, Monserrate’s lawyer, Adv A D’Sa, contended that the CBI had neither investigated his client’s countercomplaint or submitted a FIR as mandated by the High Court.
“The CBI filed a closure report with the Judicial Magistrate First Class in response to Atanasio Monserrate’s counter complaint.
Adv. D’Sa states that the inquiry into the counter complaint has an effect on the ongoing Sessions Court trial since we want to talk about the police officers and their role in the case.
CBI Prosecutor Naushad said the application filed by Monserrate has no merits and hence prayed for its dismissal, saying the trial will only be dragged if the application is entered by the Court.
