PANAJI: The National Green Tribunal has dismissed the review petition of Goveia Waterfront, Siolim against demolition ordered by the Goa Coastal Zone Management Authority (GCZMA).
This review application was filed before this Tribunal on 30.03.2019 for review of the order dated 15.05.2017 dismissing the appeal against the order of the GCZMA dated 07.04.2017 requiring demolition of illegal construction in violation of CRZ Notification.
The GCZMA had conducted the site inspection and found that the construction was illegal which order was upheld by this NGT.
“The ground for review is said to be subsequent inspection by the GCZMA dated 22.06.2018 annexed to the review application. We have perused the same which does not show any finding that the structure in question is outside the NDZ. On the contrary, the minutes of the meeting dated 28.08.2018 specifically record that the appellant is failing to comply with the earlier orders which led to passing of further order dated 20.09.2018,” the NGT said.
“In view of the above, we do not find any merit in the review application which is dismissed and matter stands disposed of,” the NGT said.
The GCZMA had directed the Deputy Collector of Bardez, O/o the Deputy Collector & SDO of Bardez, Mapusa-Goa to ensure compliance to the direction issued by the Authority and to recover the cost incurred for such compliance from M/s Gouveia Resorts Pvt. Ltd. as arrears of land revenue.
Further, the authorities, was also asked to submit a compliance report within 4 weeks from the date of receipt of this letter to this Authority. The proceedings are disposed of accordingly.
