MARGAO: The Margao Special Court has allowed applications by Babush Monserrate seeking certified copies of the closure report filed by CBI before Judicial Magistrate First Class(JMFC), Panaji, as regards the original complaint and counter complaint filed by Monserrate and wife Jennifer against the police.
Submission of original FIR before the court has also been permitted. The Margao Special Court was hearing the 2008 Panaji police station attack case.
The court however withheld the decision on the application moved by the accused asking for a closure report on the counter FIR lodged against the police regarding which the Central Bureau of Investigation (CBI) had filed a closure report after the PP sought additional time to study the matter.
CBI, Mumbai had charge-sheeted Monserrate couple and 34 others under Sections 143, 147, 148, 149, 153, 324, 325, 326, 332, 333, 427 and 435 of IPC and Section 3 of Prevention of Damage to Public Property Act, 1984.
Justice Manish Pitale of the Bombay High Court at Goa on December 22, in a 31 paged judgment, while dismissing the applications seeking quashing of the proceedings, directed that the trial should commence and be expedited as there was prima facie evidence against the accused.
