PANAJI: The High Court of Bombay at Goa quashed aside the summons issued by CBI to a practising lawyer to appear as a witness against his own client.
During the hearing, the Court noted that revealing information shared by the client would constitute a breach of privilege while nullifying the order.
“The High Court quashed the summons issued to my client as it would be a breach of privilege,” Adv Kaif Noorani said.
According to section 126 of the Indian Evidence Act and the rules of the Bar Council of India, a lawyer who receives information from a client in his professional capacity has a duty to keep it confidential and not disclose it without the client’s express consent, as advised by the lawyer’s counsel.
