    ILLEGAL MINING? Commundiade of Navelim terminates land usage contract with Damodar Mangalji

    Panaji: In a major decision, the Communidade of Navelim, Sanquelim has decided to terminate permission for usage of communidade land by Damodar Mangalji & Co Ltd for grave irregularities.

    Based on complaints filed by locals, the Communidade has issued a public notice and also written to the company as well as the SIT (illegal mining), SP Crime Branch on the matter.

    The letter says the Managing Committee of this Communidade met on issues pertaining to the land owned by the Communidade of Navelim, which came to be discussed as agenda item pursuant to complaints received by this Communidade as regards the said subject matter & its own inquiries/inspections.

    Accordingly, it says, the managing committee has discussed and deliberated on the same in a detailed manner.

    The communidade says the subject matter appears to be seriously damaging & which are directly related to the management and use of the Communidade Land, hence the matter assumes an extremely serious nature.

    “In view of the material placed before the Communidade and deliberated at the Managing Committee meeting, pursuant thereto it is clear that the land of the Communidade used by Damodar Mangalji and Co. Ltd. and Damodar Mangalji Mining Company is subject to grave illegalities of serious nature, due to acts by you, ramifications of which are serious thereby warranting the passage of resolution and taking a decision as contained in the proceedings appended hereto which may be considered herein as reiterated afresh for the sake of brevity,” the letter to the company says.

    Hence, it says, the above acts by your Company being detrimental to the interest of the Village, it has been decided and resolved to terminate the arrangement with DMC for the following three parcels of Land viz.

    “1. Land under Survey No. 192/0, 196/0, 204/0 and 206/0(part) admeasuring area 20.00.00 Ha; 2. Land under Survey Nos. 192/0 and 196/0 admeasuring area of 10 Ha; Land under Survey Nos. 188/0,189/1, 2, 4, 5 and 190/1, 2, 4, 5, 6, 7 admeasuring area 5.45.75 Ha,” the letter says.

    The Communidade notes that no benefit has accrued to the Communidade in as much as the same has damaged the components of the Communidade together with damage to the institution.

    “Communidade is not duty bound to renew the said arrangement of usage of their own Land for the reasons contained/recorded exhaustively in the proceedings, Consequently your right of use of the said land has extinguished and thus you are not entitled to use the said land or enjoy the same or possess the same in any manner and hence you are called upon to take away your belongings/items, if any, in the said land within 30 days from the date of receipt of this notice failing which the continuance of the said item, if any, shall constitute an act of trespass by you,” it says.

    Locals complained that the company was involved in large scale illegal mining in the leased plots.

    Dhakul Naine Nagrik Kriti Samittee had alleged that Communidade had given land to DMC only because it had given livelihood to some villagers in Navelim village.

    Further, it said, DMC removed all villagers of Navelim & Maina, polluted all agricultural land, lake and not even paid compensation for past 7 years.

    Moreover, the Samittee says, “DMC has been resorting to all kinds of illegalities. They have even buried and hidden stolen ore, in the property of the Communidade of Navelim.”

    The Samittee also alleged that DMC has hidden by burying about 75,000 to 1 lakh tonnes of lumpy illegal ore at Navelim plot. Plot incharge is fully aware of the same.”
