Panaji: The disqualification case against the 10 Congress MLA has now been scheduled for December 10, 2021 as the respondents sought a similar case by Sudin Dhavalikar be linked together.
Girish Chodankar, president of Goa Pradesh Congress Committee’s Writ Petition challenging the Order dated 20.04 2021 passed by the Speaker, Goa State Legislative Assembly, dismissing his Disqualification Petition seeking disqualification of 10 defected MLA came up for hearing before the Hon’ble High Court of Bombay at Goa on 22.11.2021.
The said Writ Petition was initially listed on 06.06.2021, wherein the presiding judge had recused himself from hearing the matter. Due to non availability of an alternate division bench in Goa, the matter was transferred to the Principal Bench at Mumbai. Thereafter, since HMJ Tatedof the Principal Bench at the Hon’ble High Court of Bombay retired.
Thereafter, on account of availability of an alternate bench at Goa, the matter was again transferred to the Hon’ble High Court of Bombay at Goa and listed on 22.11.2021.
When the matter was called out, Mr. Vivek Tankha, Ld. Senior Advocate alongwith Mr. Abhijit Gosavi, Adv appearing on behalf of the Petitioner apprised the bench that the said matter is purely on a question of law which needs to be addressed urgently in order to protect the credibility of democracy.
He further apprised that since another matter with similar issues has been filed by Mr. Sudhin Dhavilikar, in which a notice had already been issued on 24.09.2021, the Hon’ble judge may issue notice in the same and tag it along with it for final disposal.
In light of the above, the above named two Writ Petitions have been listed for final disposal at admission stage on 10.12.2021.
In the meantime, the Respondents, i.e the Speaker along with 10 defected MLA’s are directed to file their replies on or before 06.12.2021.
Thereafter, the Petitioner to file the his rejoinder on or before 09.12.2021.
Furthermore, the Hon’ble bench has asked all the parties to file their Written Statement on or before 09.12.2021.
Accordingly the matter will be heard and decided finally on 10.12.2021.
