PANAJI: The jail sentence given to Dhanvy Naik, who was found guilty in a check-bouncing case, has been temporarily suspended by the Bombay High Court in Goa.
On October 26, 2023, Judicial Magistrate First Class (JMFC) Ponda issued an order under Section 138 of the Negotiable Instruments Act, imposing a two-month jail sentence on him.
In order to avoid facing an additional two months in jail, he was ordered to compensate the complainant with Rs 1.06 lakh. After the Sessions Court denied his appeal on January 7, 2025, he turned to the High Court for remedy.
On January 24, 2025, the Appellate Court ordered the Applicant (Naik) to turn himself up at the JMFC, Ponda. Nevertheless, a Criminal Revision Application was submitted to contest the Sessions Court’s ruling.
In light of this, the applicant’s sentence will remain suspended until the JMFC, Ponda, issues additional orders regarding the application and the applicant provides a bail bond of Rs 5,000 with one surety in the same amount within a week from today (Thursday), according to the ruling made by Justice Valmiki Menezes in dismissing the case.
Naik deposited Rs 77,000 before the Sessions Court in Panaji, which was seated in Ponda, during the appeal procedures.
He then stated that he would be willing to deposit the remaining Rs 29,000 within two weeks. The Registry was also instructed by the High Court to accept the payment.
