Goa IDC has informed that pursuant to the disposal of the Civil Appeals, the Status Quo directed by the Hon’ble Supreme Court is operating only against the land measuring 12,32,000m2 at Kerim Ponda and another measuring 2,03,445 m2 at Verna being part of the petitions CA no. 9711/2013, CA no. 9712, CA no.6825/2014, CA no. 5662/2014 and CA no.9713/2013 and not against the repossessed land.
It may be informed that Goa IDC had allotted land total measuring 3840886 m2 for setting up of SEZ at Verna, Kerim in Ponda and Sancoale in Mormugao to 7 allottees, namely M/s. Meditab Specialities Pvt. Ltd., M/s. Peninsula Pharma Research Centre Pvt. Ltd., M/s. K. Raheja Corp. Pvt. Ltd., M/s. Paradigm Logistics & Distribution Pvt. Ltd., M/s. Inox Mercantile Co. Pvt. Ltd., M/s. Planet View Mercantile Co. Pvt. Ltd. and M/s. Maxgrow Finlease Pvt. Ltd. respectively.
Status quo not operative on repossessed SEZ land: Goa-IDC

PANAJI: The Goa Industrial Development Corporation has informed that the Status Quo is not operative as against the area which has been already repossessed by Goa IDC after refunding the amounts as per the Judgment of the Hon’ble Supreme Court nor there are any legal impediments for GIDC to auction the plots I-1 to I-31 advertised under Tender notice no. GIDC/21-22/01 recently.

The above said allotments were challenged before the Hon’ble High Court of Bombay at Panaji and the Writ Petition nos.263/08; 310/08; 316/08; 314/08; 380/08; 349/08; 438/08; 436/08; 437/08 & 501/08 were disposed of by the Hon’ble High Court under common Judgement and Order pronounced on 26/11/2010.
Goa IDC had further informed that against the said Judgement and Order Civil Appeals were preferred before the Hon’ble Supreme Court, and the Hon’ble Supreme Court in SLP no. 36458/2010 (CA no.9336/2013) was pleased to direct all the parties to maintain status quo as of the date of the order. The same order was made in the other SLP’s which were filed.
Pursuant to the Status Quo, the Civil Appeal no. 9336/13 along with Civil Appeal no.9343/13, CA no.9698/13, CA no 9714/13, CA no. 9717/2913, CA no.9718/2013, Cano. 9715/13 and CA no.9716/2013 came up for hearing before the Hon’ble Supreme Court on 31/07/2018, and the Court vide its Judgment dated 31/07/2018, was pleased to dispose of the said appeals in terms of the Government decision dated 30/07/2018 and Goa IDC was directed to make the refund of the amounts along with interest expeditiously and at any rate within three months.
In compliance M/s. Peninsula Pharma Research Centre Pvt. Ltd., M/s. K. Raheja Corp. Pvt. Ltd., M/s. Paradigm Logistics & Distribution Pvt. Ltd., M/s. Inox Mercantile Co. Pvt. Ltd. and (6). M/s. Planetview Mercantile Co. Pvt. Ltd. have surrendered their respective land to Goa IDC and accepted the refund of the amount. The total land repossessed by Goa IDC is 25,05,441m2.
All the related petitions have been disposed of, and the PIL petitioners were duly represented by their advocates during the hearing and orders made. On account of the said Orders of the Hon’ble Supreme Court, namely M/s. K Raheja, Paradigm, M/s. Inox Mercantile and Planet View have been accordingly deleted as parties vide its order dated 22/10/2018 made in Civil Appeal no.9710/2013 entitled Franky Monteiro V/s State of Goa.
