PANAJI: In light of the fact that Darshan Rama Bhisaji, the accused, is 42 years old and still in critical condition, the North Goa District & Sessions Court has denied his bail application while they wait for permission to record his dying declaration.
Darshan is accused of hitting Gauresh Bhisaji in the head last month with a metal rod, causing severe injuries and bleeding.
The victim was deemed unfit to testify during the hearing of Darshan’s bail application, despite Darshan’s assertion that Gauresh has been released.
The victim’s critical condition was reported to the court, and a request for a dying declaration has been made to the sub-divisional magistrate.
The submission states, “Due to the victim’s severe condition, several attempts to record his statement have failed.”
The victim, who lives in the same neighborhood as the accused, could be threatened by Darshan, the Mandrem police claimed in their opposition to the bail application. “There is a significant likelihood that Darshan will threaten the victim, whose statement has not yet been recorded, if bail is granted.
Aside from this, the victim, the accused, and the complainant—the victim’s family—all reside in the same area. Therefore, there’s a good chance Darshan could threaten the witnesses if the bail is approved, the statement stated.
Irshad Agha, the Sessions Judge, dismissed the bail plea while accepting the police submission.
