PAANJI: Balkrishna Busa, a poor parent fighting for his children’s rights, has finally won a case against the State Education Department.
In the year 2014, both daughters were studying in the primary school by name Royal High School at Taleigao. Balkrishna’s wife, Mrs Geeta Balkrishna Busa, filed various police complaints before the Panaji police station against the Headmistress of Royal High School, Taleigao, for harassing her minor daughters during school hours by using filthy and abusive words. She had made them do unwanted things such as washing school toilets, forcing them to eat near the toilets, calling them OBC etc.
Complaints were also made to the director of education, Gajanan Bhat, requesting him to take necessary action against the headmistress.
However, the director failed to initiate any actions. As such, Geeta approached the Goa State Commission for Protection of Child Rights, who then took up the matter and subsequently vide order dated 25/08/2014 directed the director of education to initiate disciplinary action against the said headmistress.
Thereafter, since the director of education did not take action as per the commission order dated 25/08/2014, Mrs Geeta Balkrishna Busa had filed a Writ Petition bearing no. 153/2015 before the High Court seeking relief to implement the said order. By order dated 21/07/2015, the HC had advised the Director of Education to initiate action against the school management in terms of the law.
Despite the High Court order, the director of education failed to take action against the headmistress and therefore, Balkrishna Busa in the year 2017 was compelled to sit on a hunger strike outside the Education Department Porvorim for 91 days and after that for 9 days at Azad Maidan, Panjim to seek justice for his minor daughters.
Balkrishna Busa used to sit across the road opposite the entrance of the department on the ground itself.
After that, on 05/04/2017, the then director Gajanan Bhat, filed a police complaint at Porvorim Police station against Balkrishna Busa, alleging that he was assaulted and obstructed from carrying out his official.
As a result, Porvorim police had registered an FIR no: 50/2017 against Balkrishna Busa and had then arrested him from the place where he was carrying on the strike.
Balkrishna Busa was charged under sections 353,323 and 504 of IPC. • Thereafter, Porvorim Police filed a charge sheet against him before the JMPC, Mapusa.
Accordingly, Balkrishna Busa engaged Advocate Pratik T. Korgaonkar from Mapusa, Goa, to defend him in the said criminal case.
Advocate Pratik argued that Busa was falsely implicated in the said criminal case by the director of education in connivance with Porvorim police.
He said that the director used the government machinery against Busa to restrain him from carrying out the strike against the department. Neither Balkrishna Busa had assaulted the director nor at any time had obstructed him from carrying out his official duty. The arrest of Busa was falsely implicated in preventing him from carrying out the strike.
On 30/07/2021, JMFC Mapusa acquitted Busa from the charges framed against him.
Upon being acquitted, Balkrishna Busa expressed his gratitude towards the Advocate for having successfully defending him in the said criminal case. Even though Balkrishna Busa has won the half battle against the education department, the motive for the agitation was started has not been established yet. The director of education has not initiated any action against the headmistress of the said high school. Balkrishna Busa says that he has full faith in the judicial system and will continue to fight the battle until he seeks justice for his daughters.
