New Delhi: A major refund process for import tariffs in the United States is set to begin, allowing businesses to reclaim billions of dollars collected under duties later ruled unconstitutional. The move follows a landmark decision by the Supreme Court of the United States, which found that former President Donald Trump exceeded his authority in imposing sweeping tariffs.
From Monday, importers and customs brokers can submit refund claims through an online system managed by US Customs and Border Protection. Companies are required to identify shipments on which they paid the now invalid duties. Approved claims are expected to be processed within a few months, although delays are anticipated due to the scale and complexity of the exercise.
The refund initiative stems from a court ruling that determined the tariffs, introduced under emergency powers to address trade deficits, infringed on Congress’s authority over taxation. A subsequent trade court decision confirmed that affected businesses are entitled to reimbursement.
The scale of repayments is expected to be unprecedented. Estimates suggest that more than 330,000 importers paid around $166 billion in tariffs across tens of millions of shipments. However, only a portion of these payments will be eligible in the initial phase, which prioritises more recent transactions and those not fully finalised.
To manage the process, authorities have introduced a dedicated digital platform for filing and tracking claims. Businesses must ensure accurate documentation, as errors could lead to rejections or delays. Experts caution that technical issues may arise during the early stages due to high demand.
While companies stand to recover significant sums, the benefits for consumers remain uncertain. Many firms had passed on tariff costs through higher prices, but there is no requirement for businesses to return refunded amounts to customers. Ongoing legal cases may determine whether some companies will need to compensate consumers.
For smaller businesses, the refunds offer potential financial relief, though concerns remain about processing timelines. The overall effort marks one of the most complex and large scale repayment exercises in US trade history.
