PANAJI: While alleging that State Election Commission is working on behest of government, Goa Pradesh Congress Committee Spokesperson Amarnath Panajikar on Friday said that SEC should not hurriedly complete the process of municipality election as Supreme Court is expected to give judgment on Tuesday.
He said that Hon’ble High Court of Bombay at Panaji has quashed the Order dated 04/02/2021 issued by the Director of Municipal Administration (DMA) notifying the reservation of the seats and has also by necessary implication struck down the Election Notification issued by the Election Commission.
One SLP has been preferred before the Hon’ble Supreme Court that relates to the Sanguem Municipality and in the said SLP No. 3937/2021 the Hon’ble Supreme Court has stayed the operation of the judgment as well as the Election Commission Notification vide its Order dated 04/03/2021.
According to him the Hon’ble Supreme Court has only stayed the directives of the Hon’ble High Court, it has not ordered the re-starting of the Election Process which was stopped on 01/03/2021, which means only the further operation of the High Court Judgment is stayed.
“SEC should respect the Process of Law and suspend the farcical exercise of Election Process till the legal points in issue are deliberated and finally decided by the Hon’ble Supreme Court.” He said.
“SEC should adhere to all rules and regulation while carrying out the process of election and not on the behest of the Chief Minister and BJP leaders.” Panajikar said.
He said that Chief Minister Pramod Sawant is happy about the ‘stay’ given by the Supreme Court as he feels that his wrong doings has got victory. “BJP should not jump to the conclusion, but should wait till the apex court gives its judgment.” He said.
