PANAJI: As a result of the victim’s petition to revoke his conditional anticipatory bail due to infractions, the Bombay High Court has summoned the accused rapist to appear on June 10.
Judge Jitendra S. Jain, the vacation judge, gave notice to both parties during the hearing, asking them to explain why the current application, which aims to revoke the bail granted, should not be heard by the same court that granted bail in light of the Supreme Court’s ruling.
Lezio Fernandes of Agonda-Canacona was granted conditional anticipatory bail, but the petitioner has prayed that it be revoked because he has broken the terms of the bail. The petitioner has claimed that the alleged accused was told not to go into the village where the victim lives after he was seen there twice.
In the event of Lezio’s arrest, a personal bond of Rs 25,000 and one solvent surety in the same amount were to be released, according to an order issued by the High Court on February 26, 2024. He was also instructed not to interfere in any way with the prosecution’s witnesses and not to go into the village where the victim lives.
In addition, the accused was ordered not to leave the State without the Sessions Court’s prior authorization and to turn in any passports he may have.
Lezio Fernandes was charged under Sections 376 and 420 of the IPC on January 25, 2024, by the Women’s Police Station in Panjim. The complaint claimed that Fernandes had sexually assaulted the complainant and had promised to marry her; however, the applicant has not kept his word.
