New Delhi: The Supreme Court of India on Friday refused to extend the transit anticipatory bail granted to Congress leader Pawan Khera in connection with a case filed in Assam. The decision requires him to seek relief from the appropriate court in the state.
A bench comprising Justice J K Maheshwari and Justice Atul S Chandurkar declined Khera’s request to continue his interim protection until Tuesday. The plea was made to allow him time to approach a competent court in Assam following the registration of a First Information Report.
The case stems from a complaint filed by Riniki Bhuyan Sharma, wife of Assam Chief Minister Himanta Biswa Sarma, over allegations related to the holding of multiple passports.
During the hearing, senior advocate Abhishek Manu Singhvi, representing Khera, argued that his client required temporary protection to pursue legal remedies. He questioned the urgency of the proceedings, expressing concern over the lack of immediate access to filing mechanisms and the need for reasonable time to approach the appropriate jurisdiction.
However, the court declined to grant any extension and clarified that Khera must move his anticipatory bail application before the competent court in Assam. It further stated that the matter would be decided independently by the concerned court based solely on the evidence and submissions presented.
The bench also made it clear that any observations made earlier by the Supreme Court should not influence the Assam court’s decision. The ruling effectively shifts the next phase of the legal process to the state judiciary, where Khera will now seek relief in accordance with established legal procedures.
