PANAJI: The Bombay High Court has held that no government can choose a “politically convenient” date for conducting elections when the periodicity of those elections is fixed by the Constitution of India.
The observation came while the High Court upheld the validity of the Goa Municipalities (Amendment) Ordinance, 2026, clearing the way for elections to 11 Municipal Councils in Goa.
The court emphasised that governments do not have an entitlement to determine election dates based on political convenience when constitutional provisions prescribe the periodicity of elections.
With the ordinance now upheld, the legal hurdle surrounding the conduct of elections to the 11 municipal councils has been cleared, paving the way for the electoral process to move ahead.
