New Delhi:The Supreme Court on Monday heard the case related to the death of former model-actor Twisha Sharma and observed that it was “deeply pained” by the growing narrative suggesting delay or bias in the investigation process.
The court directed that the investigation in the case be transferred to the Central Bureau of Investigation (CBI), stating that the matter involved an “unfortunate unnatural death” and required a fair and impartial probe.
During the hearing, Chief Justice of India Surya Kant referred to a media report that had raised questions about possible institutional bias, noting that it prompted the court to take suo motu cognisance of the matter.
The bench observed that concerns had been raised regarding the impartiality of the investigation, particularly since the deceased’s husband is a practising lawyer and his mother is a former district judge. It noted that these factors had led to allegations of possible influence over the probe.
The court also acknowledged that a narrative had developed suggesting that the judiciary itself had impacted the fairness of the investigation, which contributed to the decision to intervene.
At the same time, the Supreme Court clarified that it was not expressing any opinion on the merits of the allegations and said it was for the investigating agency to examine all aspects of the case independently.
The bench further noted that the Madhya Pradesh High Court had already ordered a second post-mortem in the matter and said the immediate focus was ensuring a fair investigation.
Urging restraint, the court advised both the victim’s family and the accused not to make public statements or engage with the media, and instead allow their versions to be recorded by investigators.
The Chief Justice also appealed to the public to trust the CBI and avoid speculation while the investigation is underway. Solicitor General Tushar Mehta assured the court that steps would be taken to ensure the CBI takes over the probe promptly.
Twisha Sharma was found dead on May 12 at her in-laws’ residence in Bhopal’s Katara Hills area, and the circumstances surrounding her death are currently under investigation.
