PANAJI: The Goa High Court has adjourned the matter concerning the detention of CJP protesters to October 19, directing the Chief Medical Officer (CMO) of Goa Medical College (GMC) to submit the medical certificates of the protesters before the next hearing.
The development follows the detention of protesters during a demonstration at Azad Maidan. Deputy Solicitor General of India Adv. Pravin Phaldesai said six protesters detained during the protest were placed under preventive detention to prevent a recurrence of earlier incidents. He stated that they were subsequently released in compliance with the High Court’s directions and sent for medical examination.
In its earlier order, the High Court directed the immediate release of seven detained protesters, observing that their detention appeared to be unauthorised in the absence of prohibitory orders issued under Section 163 of the Bharatiya Nagarik Suraksha Sanhita (BNSS).
The court had also directed the Police Inspectors of Panaji and Pernem to file affidavits in connection with the petitions challenging the detentions. The police inspectors have since submitted their affidavits before the High Court.
However, the GMC CMO has not submitted the medical certificates as directed by the court. The High Court has now instructed the CMO to produce the certificates by the next hearing on October 19.
Phaldesai said the police had filed an affidavit, while the medical reports were still awaited. All the detained protesters have been released in compliance with the High Court’s order.
The matter will come up for further hearing on October 19, when the court is expected to consider the submissions and the pending medical certificates.
