PANAJI: Goa govt has notified the controversial Goa Legislative Diploma No. 2070 Dated 15-4- 1961 (Amendment) Bill, 2023, after it was assented to by the Governor of Goa on June 16, 2023.
The bill passed by the Legislative Assembly of Goa on March 31,2023 amid protest from opposition benches also allows the government to acquire comunidade lands for public projects, with the prior consent of the respective comunidades.
The bill also aims to streamline the process of election of the members of the managing committee of comunidades.
The bill gives powers to the government to suspend a comunidade and appoint government officials to take charge of the affairs of a Comunidade if gov committee works against the interests of people.
The bill also aims to facilitate the development of lands by private agencies and to regulate the process of grant of land by comunidades.
As explained, in any comunidade, there are two types of members, namely, the “Gaunkars” (or joneiros) and the shareholders. By and large, both have equal rights in so far as holding office as a comunidade is concerned.
Out of the profits of a comunidade, the Gaunkars receive what is known as a “zonn”, while the shareholders receive a dividend. The formula for such apportionment depends on the private law of each comunidade.
