PANAJI: Following the judgement passed by the Block Development Officer, Mapusa, Stay LP Hotel Royal Star (Bloo Resort) bearing H.No. 528/1 in Sy.No. 329 /4 and 329/11 of Village Anjuna at big Vagator has been sealed by V.P. Anjuna-Caisua.
The case of the Appellant Ranjana Parab was that, to stop the businesses and seal the said premises/hotel/guest house, kitchen, restaurant cum bar etc. along with all
the legal consequences run by the Respondent No. 2 M/S Zoy Stay CLP for carrying illegal business of hotel in the name of Hotel Royal Star (Bloo Resort) bearing H. No. 528/1 in property Surveyed under No. 320/4 and 329/11 of Village Anjuna, situated at Big Vagator, Anjuna, Bardez
Respondent cannot deny the fact they continue to carry on the business of Hotel/Guest House/Restaurant cum Bar in the said premises.
“Further from the complaint dated 07/01/2022 filed by the Appellant, it appears that inspite of filing a complaint against the illegal activities and business carried out by the Respondents and Village Panchayat of Anjuna -Caisua has failed in its statutory duties of either stopping the illegal business or conveying any decision on the said complaint,” the BDO said.
The BDO further said that neither the Village Panchayat of Anjuna -Caisua nor the respondent no.2 has produced in this Appeal any licence granted to carry out the business of Hotel/ Guest House/ Restaurant and Bar in the Said Premises, which further proves that Respondent in violation of section 70 and 71 of the Goa Panchayat Raj Act, 1994 is illegally carrying out business and hence
Considering the above discussion, I am inclined to decide Point No-II for determination in the Affirmative and pass the following Order:
“The Respondent No. I Village Panchayat of Anjuna -Caisua, Bardez-Goa is hereby directed to stop the business and seal the said premises/ hotel/ guest house, kitchen, restaurant cum bar etc. along with all the legal consequences run by the Respondent No. 2 M/s Zoy Stay LLP for carrying illegal business of hotel in the name of Hotel Roval Star (Bloo Resort) bearing H. No. 528/1 in property Surveyed under No. and 329/11 of Village Anjuna, situated at Big Vagator, Anjuna, Bardez
Goby sealing the said Premises within 15 days from the date of receipt of this Judgment and Order.
The Secretary of Village Panchayat of Anjuma – Caisua. Bardez – Goa to comply with the above directions as per
Sec. 47 (B) of Goa Panchayat Raj Act, 1994.No Orders as to cost,” the order said.
