Panaji: Sahil Tagora, the advocate for Goa Pradesh Congress Committee president Girish Chodankar has said that the disqualification matter which was listed for today has suddenly gone missing from the Supreme Court Board.
The advocate has now written to the Supreme Court Registrar for petition be listed for urgent hearing.
“The matter was earlier mentioned on 03.03.2021 when the tentative date was being reflected as 08.03.2021. A request was made that the matter be not deleted. However, despite specific directions of the Court to list the matter in the first week of March, and a Mentioning Application having been duly filed, the matter was deleted from 08.03.2021, and not listed. As of now, no tentative date is being reflected on case status,” he said.
He said that there were grounds for urgency in the matter as the Writ Petition seeks directions qua the Respondent No. 1 insofar as the Disqualification.
“Petition filed by the Petitioner before him is pending since more than 18 months now. The said delay is in direct violation of the judgment of this Court in Keisham Meghachandra Singh v. Hon’ble Speaker Manipur Legislative Assembly (2020 SCCOnline SC 55, Anx. P8). Since the main issue in the Writ Petition itself concerns inordinate delay by the Respondent No. 1, any additional delay in listing of the matter, despite specific directions of the Hon’ble Court to list the same, will irreversibly prejudice the Petitioner’s case,” he said.
Therefore, the advocate prayed that it is respectfully prayed that the Registrar take it for urgent hearing.
“List the W.P.(C) No. 525/2020 for hearing before the Hon’ble Court on 12.03.2021; ii. Exempt the Petitioner from submitting a signed and notarized affidavit along with this Application. The Petitioner undertakes to file a notarised affidavit, or any deficit court fee.
The counsels for the Petitioners pray that they be permitted to appear by way of a VC hearing through their personal laptops,” he said.
